Abstract
The purpose of This thesis is to make an independent study of the trust instrument with the view of: setting forth the basic characteristics of trusts, the duties and skill required in the administration of trusts , the uses of different type's of trusts, and finally to make' recommendations regarding trust instruments.
Chapter Two of this thesis will give a definition of what a trust is as well as defining the terminology that accompanies a discussion of trusts. Also, Chapter Two will present the different types of trusts, their essentials, how they are created, and reasons why they are used.
Chapter Three will list the duties of the trustee that are required in the administration of a trust arrangement and will discuss each of these duties in regard to what is expected of the trustee.
Chapter Four will provide case illustrations exemplifying the use of trusts with a particular emphasis on how a trust can be effectively used to reduce and avoid unnecessary taxation on property that is to be transferred to other persons.
The final chapter of this thesis contains a summation of the research involved in this thesis and provides recommendations regarding the use of the trust instrument.
